Employer Nomination Direct Entry (subclass 186)

As the name indicates, this stream permits employers directly nominate their workers for permanent residence without negotiating a labor Agreement.

Two stages to Direct Entry Process are:

  1. Employer will first lodge a nomination application indicating the position and the person they are nominating.
  2. Then, Employer lodges a visa application. Both the nomination and visa application can be lodged on the same day, but consideration will be given to nomination first, and its approval is required before the approval of visa application.

This visa permits you: –

  • stay permanently in Australia.
  • study or work in Australia.
  • Entitled to enroll for Medicare (Australia’s public healthcare scheme).
  • Sponsor your relatives to come to Australia.
  • Travel: – Travel inside or outside Australia for 5 years. In case you want to travel after the initial 5 year’s travel facility.
  • You will have to apply for and be granted a Resident-Return (RRV) to re-enter Australia as a permanent resident.
  • If you become an Australian citizen then you don’t require a visa to enter Australia and can use it to travel and from Australia.
  • If you leave Australia after travel facility date has expired, without having another permanent visa with having a valid travel facility, for instance, a RRV, might be you won’t be able to return to Australia as a Permanent Resident.
  • Apply for citizenship (if eligible).

Newly arrived residents may have to wait to access benefits of Australian Government.

Duration of Stay: –

  • As it is a permanent visa, you can stay for an indefinite time.
  • Your permanent residence starts on the day of the grant of the visa.

Family: –

  • Family members must be included any time of lodge of your application but, before deciding of application.
  • Family members, applying for the visa must qualify health and character requirements of Australian Government.
  • Members who can be enclosed in your application:-
  • Partner
  • Dependent child or stepchild.
  • Dependent child or stepchild of your partner.
  • Dependent child or stepchild of you and your spouse’s  dependent child or step child
  • You can include someone who holds a subclass 457 or subclass 482 visa.

Cost: – AUD$4,045–Main Applicant.

  1. Additional charges are there for other family applicants applying.
  2. Second Installment: – Family members having age above 18 years or above need to pay Second Installment, those who:
  3. Applies with the applicant for this visa.
  4. Has less than Functional English.
  5. Second Installment is AUD4,890
  6. Other costs include are those of health checks, police certificates and biometrics

Place to Apply from: –

  1. Applicant may apply this visa from onshore or offshore.
  2. If you are onshore, you must hold a substantive or a related bridging visa A, B or C.
  3. In case of No Further Stay Condition on Substantive visa, still you might file an application in certain situations.
  4. Applicant can be inside or outside Australia at the time of deciding on application.

Processing Time: –

For 75% of applications: 6 Months

For 90% of applications: 7 Months.

Eligibility Criteria: –

  • You need to have an occupation that is on the eligible skilled occupation list.
  • You should have a minimum of 3 years of relevant work experience, unless exempted
  • Own a positive skill assessment, unless exempted.
  • Applicant must be nominated by an Australian Employer, whose business is lawfully and actively operating.
  • You have to start your employment within the period of 6 months of:
  • Entry to Australia (if the visa was granted while offshore).
  • The grant date of visa (if the visa was granted while you are inshore).
  • Applicant must meet the Health and Character needs. Family members, applying for the visa must qualify health and character requirements of Australian Government.
  • Family members, even if not migrating to Australia, might also have to qualify character requirements.
  • Have paid outstanding debt (if any) to the Australian Government: – If applicant or any family member of the applicant owes any debt to the Australian Government, it must be paid back or at least have formal Arrangements to pay it back.
  • Australian Values Statement: – You must sign the Australian values statement, which assures that you will abide by all Australian laws and will respect their way of living.
  • As a Main Applicant, you need to show that you possess Competent English
  • Obligations: – It is necessary that you and your family abide by all laws of Australian Government.
  • It is expected that the applicant will work for nominating employer for a minimum of 2 years.
  • You have to start your employment within the period of 6 months of:
  • Entry to Australia (if the visa was granted while offshore).
  • The grant date of visa (if the visa was granted while you are inshore).
  • Usually you must be under 45 years of age to apply for this visa.

 Not be eligible: –

  1. In case of Previous Cancelled Visa.
